These rights can arise under state or federal law, an insurance contract, or both.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The terms &#8220;lien&#8221; and &#8220;reimbursement claim&#8221; are often used interchangeably. Not every Claimant will have a lien, and the existence and amount of any lien reimbursement claim must be reviewed individually<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-medium-font-size\" style=\"font-style:normal;font-weight:700\"><strong>Am I required to go through the lien resolution process?<\/strong><\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\"><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.&nbsp; The Court, the Plan and the PI Trust Agreement all require the review and resolution of each Claimant\u2019s liens in order for them to receive their settlement payment.<\/p>\n\n\n\n<ol start=\"3\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list has-medium-font-size\">\n<li class=\"\"><strong>Do I need to do anything to complete lien resolution?<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You should not contact Medicare, Medicaid, your health insurance company, or any government agency. Doing so may cause delays, duplicate files, or other slowdowns. You may, however, be copied on communications from your insurance provider(s) to the Purdue Lien Resolution Administrator, Med Lien Solutions.&nbsp; If you receive these communications, you should not take any action, but you should keep them for your records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement program and lien resolution process are designed to address potential healthcare lien\/reimbursement claims on your behalf. &nbsp;The Claims Administrator has hired an expert Lien Resolution Administrator to handle this task.&nbsp; The Company\u2019s name is Med Lien Solutions, and its job is to check each Claimant against standard health insurance companies and any government healthcare programs, determine if there are eligible claims related lien charges owed and negotiate down any lien claims.<\/p>\n\n\n\n<ol start=\"4\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list has-medium-font-size\">\n<li class=\"\"><strong>What healthcare lien\/reimbursement claims are being reviewed?<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">As part of the settlement process, several programs are used to review and resolve potential healthcare lien\/reimbursement claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Medicaid programs<\/li>\n\n\n\n<li class=\"\">Many of the nation&#8217;s largest private health insurance plans through Private Lien Resolution Programs (PLRPs)<\/li>\n\n\n\n<li class=\"\">Medicare and other governmental healthcare programs, like TRICARE, Veterans Affairs (VA), and Indian Health Service (IHS) have been resolved as part of the overall bankruptcy plan, and the lien amount will be based on each Claimant\u2019s eligibility for these programs.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Not every health insurance plan participates in every settlement program, and reimbursement rights may vary based on your individual circumstances. The goal is to allow claimants to receive part of their payment sooner instead of waiting until the lien process is complete.&nbsp; Any holdback amount not needed to pay liens will be paid to you after all applicable liens are paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A holdback is meant to cover possible lien claims from more than one source and should not be interpreted as the amount owed to any single healthcare program or insurance plan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Holdback amounts are based on our experience in similar settlements, historical reimbursement data, the lien resolution program involved, applicable state laws, and other factors that may affect potential reimbursement obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the review process is complete, any holdback amount that is not needed to resolve valid reimbursement claims will be released to the Claimant.<\/p>\n\n\n\n<ol start=\"13\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list has-medium-font-size\">\n<li class=\"\"><strong>How is the holdback amount calculated?<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Holdback amounts are estimates based on information available at the time of payment. They are intended to account for potential reimbursement obligations that may arise from healthcare coverage, government healthcare programs, applicable state laws, and other factors that may affect lien resolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amount held back is not based solely on one healthcare program or one health insurance plan. In many cases, multiple healthcare programs or insurance arrangements may need to be considered as part of the review process.
